Divorce Law in Jackson County

All divorces in Jackson County follow Michigan state law. Under MCL 552.6, Michigan is a no-fault state. You don't have to prove wrongdoing. The only ground for divorce is that the marriage has broken down and cannot be saved. The 4th Circuit Court judge will not consider fault when dividing property or deciding spousal support in most cases.

MCL 552.9 sets the residency requirements. One spouse must have lived in Michigan for at least 180 days and in Jackson County for at least 10 days before filing. These thresholds are checked at the time the petition is filed. If neither spouse meets the Jackson County residency requirement, the case should be filed in the county where one of them does live.

Waiting periods apply in every Jackson County case. If no minor children are involved, the court cannot enter a final divorce judgment for at least 60 days from the filing date. If minor children are part of the case, that wait extends to 180 days. These are minimum periods. Most cases take longer due to negotiations, discovery, and scheduling. The 4th Circuit Court judge can, in limited circumstances, shorten the waiting period for good cause.

Marital property is divided under the equitable distribution standard in MCL 552.19. The court divides assets fairly, but not necessarily equally. Spousal support is determined under MCL 552.13, with the judge weighing both parties' finances and the circumstances of the marriage. The full text of these statutes is at legislature.mi.gov.
